Terms of Sale

1. Scope

These Terms of Sale exclusively govern the purchase of paid subscriptions to the Tallyd service (hereinafter "Service").

These Terms of Sale supplement the Terms of Use which remain applicable for all matters not addressed in these Terms.

2. Offers and Pricing

2.1 Pro Subscription

2.3 Price Changes

Prices may be changed at any time. Users will be notified by email at least 30 days before new prices take effect.

The new price applies from the next renewal. If the User refuses the new price, they can cancel their subscription before renewal without penalty.

3. Order Process

3.1 Subscription

Subscribing to the Pro plan is done online:

  1. Log in to your Tallyd account
  2. Go to Settings > Subscription
  3. Select the Pro plan
  4. Enter payment information via Stripe
  5. Accept the Terms of Use and Terms of Sale (mandatory checkbox)
  6. Confirm payment

3.2 Order Confirmation

A confirmation email is sent immediately after payment, including:

  • Summary of the subscribed plan
  • Start and end date of the current period
  • Amount charged
  • Link to PDF invoice

4. Payment

4.1 Payment Methods

Payments are processed by Stripe. Accepted methods:

  • Credit cards (Visa, Mastercard, American Express)
  • Apple Pay / Google Pay
  • SEPA direct debit (where available)

Security: Stripe is PCI-DSS Level 1 certified. Tallyd never stores your credit card information.

4.2 Billing

Billing is monthly, in advance, on the subscription anniversary date. A compliant invoice is issued for each payment and accessible from the Stripe Customer Portal or by email.

4.3 Payment Failure

In case of payment failure:

  1. Immediate notification by email
  2. 3 automatic retries over 7 days
  3. If failure persists: account downgraded to Free after 7 days
  4. Data beyond 30 days will be archived (not deleted)

5. Trial Period

5.2 End of Trial

3 days before the end of the trial, a reminder email is sent. At the end of the trial, if no subscription is purchased, the account automatically reverts to the Free plan.

6. Right of Withdrawal

In accordance with applicable consumer protection laws, you may have a 14-day right of withdrawal from the subscription date, without having to justify reasons or pay penalties.

6.1 How to Exercise

To withdraw, send an email to:

6.2 Refund

In case of valid withdrawal, a full refund will be made within 14 days via the same payment method used for the order.

6.3 Waiver

If you have actively used the Service during the withdrawal period (more than 5 logins and/or use of Pro features), you acknowledge having requested immediate execution of the contract and accept to lose your right of withdrawal for the consumed period.

7. Renewal and Cancellation

7.1 Automatic Renewal

The subscription renews automatically each month on the anniversary date. A notification email is sent 3 days before renewal.

7.2 Cancellation by User

The User can cancel at any time via Settings > Subscription > Cancel, or via the Stripe Customer Portal.

Effect of cancellation: The subscription remains active until the end of the paid period. No pro-rated refund is made for the remaining period.

7.3 Cancellation by Publisher

The Publisher may cancel the subscription:

  • With 30 days notice: Service cessation (pro-rated refund)
  • Without notice: Serious violation of Terms of Use/Sale (no refund)
  • Without notice: Persistent payment failure (after reminders)

8. Legal Guarantees

In accordance with applicable consumer protection laws, you benefit from legal guarantees of conformity for digital content.

8.1 Conformity Guarantee

The Service must conform to the contract and present the characteristics described in the documentation. In case of non-conformity, you can request the Service to be brought into conformity or, failing that, a price reduction or contract termination.
